Welcome to Parcheggio Positano fratelli Milano. By accessing our website, booking a parking spot or renting a scooter, you agree to be bound by these General Terms and Conditions.

Please Note: These terms govern the online booking process and general service rules. However, the service relationship is ultimately perfected and governed by the specific Rental Agreement (for scooters) or the Parking Contract (for cars) signed or issued physically upon arrival.

Any specific detail, derogation, or condition contained in the physical contract signed at our desk prevails over these general online terms.

 

SECTION 1: SCOOTER & VESPA RENTAL

1.1 Driver Requirements & Experience

To rent a scooter or Vespa, the driver must meet the following strict criteria. Parcheggio Positano fratelli Milano reserves the right to refuse the rental if these conditions are not met.

  • Driving License:
    • EU Citizens: Must present a valid Driving License Category A1 or B (Car License).
    • Non-EU Citizens (USA, UK, Australia, Canada, etc.): Must present a valid National Driving License AND an International Driving Permit (IDP).
    • Original Documents: We must see the original physical card. Photos, PDFs, or photocopies on smartphones are NOT accepted by Italian law.
  • Mandatory Experience:
    • Previous experience riding a scooter is MANDATORY. The Amalfi Coast roads are narrow, curvy, and busy.
    • Test Drive Policy: For your safety, we may require a short test drive upon pick-up. If you demonstrate that you are unable to drive the scooter safely, we will cancel the rental immediately and NO REFUND will be issued. If you are a beginner, please do not book a scooter.

 

1.2 Rental Period & Operating Hours

  • Pick-up & Drop-off: Service is available from 08:30 AM to 08:00 PM (20:00) at our hub in Viale Pasitea, 282.
  • Late Returns: The vehicle must be returned at the specific date and time indicated in the contract.
    • A tolerance of 30 minutes is allowed.
    • After 30 minutes, a penalty of € 20.00 will be charged for every hour (or fraction of an hour) of delay.

 

1.3 Rates, Payments, and Inclusions

  • Payment: Payment must be made at the time of booking (online) or upon vehicle collection.
  • Included: Third-party liability insurance (RC Auto), unlimited kilometers, 2 helmets, top box, and windshield (where applicable).
  • Excluded: Fuel, parking fees elsewhere, highway tolls, and fines.
  • Fuel Policy: The vehicle is delivered with a full tank and must be returned with a full tank. Failure to do so will result in a refueling service charge plus the cost of fuel.

 

1.4 Cancellation & No-Show Policy (Scooters)

  • Cancellations: Free cancellation is allowed up to 48 hours before the scheduled pick-up time. Cancellations made within 48 hours are non-refundable.
  • No-Show: If you fail to show up for your reservation at the agreed time, the reservation is considered cancelled and NO REFUND will be issued.
  • Lack of Skill: As stated in section 1.1, cancellation due to the driver’s inability to operate the vehicle safely is non-refundable.

 

1.5 Vehicle Condition & Customer Responsibility

  • Inspection: The Customer acknowledges receiving the vehicle in excellent condition. Any existing damage must be reported before leaving the hub.
  • Custody: The Customer is responsible for the custody of the vehicle, keys, and accessories with the diligence of a “good family father” (reasonable care).
  • Usage: The vehicle must only be driven by the person(s) identified in the contract. Driving under the influence of alcohol or drugs is strictly prohibited and voids all insurance coverage.
  • Helmets: Wearing the provided helmet is mandatory by law for both driver and passenger.

 

1.6 Damages, Theft, and Loss

  • Damage Check: The Lessor reserves the right to check the vehicle for 15 days after return. Hidden damages caused by the Customer’s negligence discovered during this period will be charged.
  • Loss of Documents: In case of loss of the vehicle’s registration documents, a penalty will be charged.
  • Theft/Total Loss: In case of theft or irreversible loss of the vehicle, the Customer must compensate the Lessor for the commercial value of the vehicle, minus any insurance payout received by the Lessor.
  • Reporting: The Customer must report any theft, accident, or damage to the Lessor immediately and to the Police authorities within 12 hours.

 

1.7 Traffic Fines

  • Fines resulting from traffic violations (e.g., speeding, illegal parking) during the rental period are the sole responsibility of the Customer.
  • Administrative Fee: In case of notification of a fine, the Lessor will charge an administrative fee of € 10.00 for processing the paperwork, in addition to the fine amount.

 

SECTION 2: CAR PARKING

2.1 Opening Hours & Access

  • Standard Hours: The parking facility is open 7 days a week from 07:30 AM to 11:30 PM (23:30).
  • Access Rules: You must arrive or collect your car within these times.
  • Night Access: Retrieval of the car outside opening hours is available exclusively for customers staying in a hotel in Positano and must be arranged in advance.

 

2.2 Valet Service & Keys

  • Key Policy: We normally operate with a valet service to optimize space. Your keys are generally kept secure in our office.
  • Exception: If there are sufficient free spots available upon your arrival, you may be allowed to keep your keys. This is at the sole discretion of the parking staff.

 

2.3 Vehicle Size & Pricing

  • Correct Booking: Customers are required to book the parking spot corresponding to their vehicle size (Small, Medium, Large/SUV, Luxury).
  • Price Adjustment: If you arrive with a larger vehicle than the one booked, you will be required to pay the price difference on-site.

 

2.4 Cancellation & No-Show Policy (Parking)

  • No-Show: If you fail to show up for your reserved parking spot, NO REFUND will be issued. We reserve the space specifically for you, preventing other sales.

 

2.5 Liability

  • The parking facility is guarded during opening hours.
  • While we take every measure to ensure safety, the parking operator is liable for the custody of the vehicle itself but assumes no liability for valuables, luggage, or personal items left inside the vehicle.

 

SECTION 3: GENERAL PROVISIONS

3.1 Jurisdiction

For any dispute arising from the interpretation or execution of these terms and the rental contract, the exclusive competent court is the Tribunal of Salerno.

 

3.2 Privacy & GDPR

Your personal data is processed in accordance with Regulation (EU) 2016/679 (GDPR). We collect data solely for the purpose of providing the requested services (rental/parking) and fulfilling legal obligations. For more details, please refer to our Privacy Policy.

 

3.3 Amendments

Parcheggio Positano fratelli Milano reserves the right to modify these Terms and Conditions at any time. The terms applicable to your booking are those in force at the time of reservation.
